Information prior to the contractual process

This website, WWW.SIETEPECADOSPALMA.COM, is owned by BREAD AR, S.L., with CIF (tax ID) B05431432 and tax address at C/ PAU PIFERRER, 23 (07011, PALMA DE MALLORCA, BALEARES, ESPAÑA), trading under the brand SIETE PECADOS PALMA.

These General Terms of Contract govern the distance selling relationship between BREAD AR, S.L. and the user or customer, in accordance with the legal provisions, in particular Spanish Law 7/1998, of 13 April, on General Terms of Contract; Law 3/2014, of 27 March, amending the consolidated text of the General Law for the Protection of Consumers and Users; Organic Law 3/2018, of 5 December, on the Protection of Personal Data and the Guarantee of Digital Rights; the General Data Protection Regulation (EU) 2016/679; Law 7/1996, of 15 January, on the Regulation of Retail Trade; and Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce.

BREAD AR, S.L. reserves the right to make any changes it considers appropriate to the General Terms without prior notice. Such changes may be made through its websites in any manner permitted by law and will be binding for as long as they remain published on the website and until they are validly replaced by later ones. However, BREAD AR, S.L. reserves the right, in certain cases, to apply Special Terms of Contract that take precedence over these General Terms when it considers it appropriate, announcing them in due time and form.

The purpose of the website is: home food delivery.
The duration of the contract is linked to the delivery of the product.

As a user or customer, you expressly declare that you know, understand and accept the terms of use and these general terms of contract. Likewise, you declare that you are of legal age and have the legal capacity necessary to access the BREAD AR, S.L. websites and to enter into contracts through them.

You must register as a user of the website in order to make an online purchase. You can access the registration section on the website itself. In accordance with applicable and current data protection legislation, BREAD AR, S.L. informs users that the personal data collected during registration and any subsequent purchase will be included in the processing system owned by BREAD AR, S.L., for the purpose of processing those actions by the user and managing any subsequent actions arising from them.

Your data will be kept for the period strictly necessary to fulfil the purposes set out above, unless there is a legal obligation to retain it.

We inform you that the legal basis for processing your data is the proper performance of the contract between the parties and your consent.

Under the rights granted to you by current data protection legislation, you may exercise your rights of access, rectification, restriction of processing, erasure, portability and objection to the processing of your personal data, as well as withdraw the consent given for its processing, by sending your request to the address mentioned above or to the email address SIETEPECADOSPALMA@GMAIL.COM.

You may contact the competent Supervisory Authority to lodge any complaint you consider appropriate.

During the purchase process you must identify yourself with the username and password provided. These details will not be made public. You are responsible for keeping the identity and password obtained when registering as a customer confidential and for using them responsibly, and you may not transfer them to anyone else. You can change your registered information at any time in your customer area. In this same section you will have access to your order history. This section is for reference only, although it can be managed, and the user may delete any records they do not need to see.

Once the purchase process is complete, the customer will receive a confirmation by email. It is essential that the user provides a valid email address during the purchase process.

All content on the website is in Spanish.

Once the service has been provided, the customer will receive the corresponding invoice.

Characteristics, offer and validity of the services

The essential characteristics of the services offered in our online shop are described there. In compliance with current legislation, BREAD AR, S.L. provides information on all items for sale, their characteristics and prices. However, BREAD AR, S.L. reserves the right to withdraw, restock or change the products offered through its website simply by changing its content. Accordingly, the products offered on the website at any given time will be governed by the General Terms of Contract in force at that time. The company may also stop offering access to these products at any time and without prior notice.

Prices

All products show the sale price in euros, including Value Added Tax (IVA). If any other tax applies (IGIC or IPSI), this will be indicated.

Charges and provision of the services

SIETE PECADOS PALMA only delivers within PALMA DE MALLORCA. Depending on the area the order is placed from, a minimum order value may be required for delivery.

Order fulfilment

BREAD AR, S.L. undertakes to deliver the order within a minimum of 45 minutes, also depending on the destination of the order and factors such as traffic or adverse weather conditions.

Payment methods

The customer may pay for their order using any of the following methods. They must indicate their choice during the purchase process:

• VISA or MASTERCARD credit card

  All transactions involving the transmission of personal or banking data are carried out in a secure environment, using a server based on the standard SSL (Secure Sockets Layer) security technology. All the information you send us is encrypted as it travels across the network.

  In addition, your credit card details are entered directly on the bank's page, in the bank's virtual POS terminal (TPV), and are not entered or stored on any BREAD AR, S.L. server.

  When paying by VISA or MASTERCARD you will always be asked for the following details: the card number, the expiry date and a Validation Code matching the last three digits of the number printed in italics on the back of your VISA or MASTERCARD card, thereby offering greater guarantees regarding the security of the transaction.

  This payment method is only valid on the website. Where the amount of a purchase has been charged fraudulently or improperly using a payment card number, the cardholder may demand that the charge be cancelled immediately. In that case, the corresponding debit and credit entries in the accounts of the supplier and the cardholder will be made as soon as possible.

  However, if the purchase was in fact made by the cardholder and the refund request was not the result of exercising the right of withdrawal or termination, and the cancellation of the charge was therefore demanded improperly, the cardholder will be obliged to compensate BREAD AR, S.L. for the loss and damage caused as a result of that cancellation.

• PayPal

  Allows you to send payments over the internet securely and conveniently. The PayPal network builds on the existing financial infrastructure of bank accounts and credit cards to create a global real-time payment solution. PayPal offers a service designed especially for those who are not satisfied with traditional payment methods. More information at PayPal.

• Cash payment

  The customer will have the option to pay when the order arrives at the address given, and can indicate in the payment options whether they will need change.

The availability of the products offered by BREAD AR, S.L. may vary depending on customer demand. Although BREAD AR, S.L. updates its stock regularly, the product ordered by the customer could be sold out at that moment. If the order cannot be fulfilled due to unavailability, BREAD AR, S.L. will notify the customer by email as soon as it becomes aware of the situation. This notification will under no circumstances exceed a maximum period of 30 days. BREAD AR, S.L. may offer the customer a choice between: supplying, at no extra cost, a product with similar characteristics or of higher quality, or, except for justified reasons that BREAD AR, S.L. can demonstrate, refunding the amounts paid for the cancelled order within that same period.

Right of withdrawal

In accordance with Article 103 of Spanish Law 3/2014, of 27 March, amending the consolidated text of the General Law for the Protection of Consumers and Users, the supply of services or goods made to the consumer's specifications or clearly personalised, or which, by their nature, cannot be returned or are liable to deteriorate or expire rapidly, is exempt from the right of withdrawal. Accordingly, we inform you that orders are exempt from the right of withdrawal.

Refund of payment

Amounts received from the customer will be refunded using the same means of payment used by the customer, unless otherwise agreed.

Return of defective products

If the product is not in good condition and the cause is not attributable to the customer, the customer will be entitled to return the product, informing BREAD AR, S.L. of the reason for the return through any of the means provided in these terms of contract, at no cost to the customer. A return due to the poor condition of the product will not be considered an exercise of the right of withdrawal. Jurisdiction

BREAD AR, S.L. also reserves the right to bring any civil or criminal proceedings it considers appropriate for the improper use of its website and content or for breach of these terms.

The relationship between the user and the provider is governed by the legislation in force and applicable in Spain. Should any dispute arise, the parties may submit it to arbitration or to the ordinary courts, in accordance with the relevant rules on jurisdiction and competence. BREAD AR, S.L. has its registered office in PALMA DE MALLORCA.

ORDERS AND RETURNS POLICY

PLACING AN ORDER IMPLIES ACCEPTANCE OF THESE ONLINE ORDERING TERMS.

Description of the online and onsite shop

The “online” and “onsite” shop of SIETE PECADOS PALMA (PALMA DE MALLORCA), hereinafter the “Shop”, is a service provided by BREAD AR, S.L. (CIF B05431432) that delivers its products to the User's home on request. The products covered by this service are those expressly listed on WWW.SIETEPECADOSPALMA.COM (hereinafter the “Website”), where Users can obtain additional information about the characteristics, availability and delivery terms of the products.

Payment will preferably be made online by credit card when the order is confirmed. Alternatively, payment to the delivery driver or waiter in cash, by restaurant voucher or by credit card will be accepted.

Delivery will be made by the restaurant with the delivery service closest to the User's address, which will also collect the corresponding payment where applicable. This payment will be made online by credit card when the order is confirmed or by other payment options.

These Shop Terms, which will not be filed individually, will remain published on the Website for consultation.

Shop specifics

• The User must have a valid and active email address in order to contract with BREAD AR, S.L. The User must also check that the email address provided works properly, that no anti-spam filters or similar mechanisms are enabled, and that there are no errors that could prevent messages from being received.
• The photographs and images of the products shown on the Website are for guidance only, and the actual appearance of some products may differ from these images.
• Before placing the order, the User must check that the product fully meets their expectations.
• If, for any reason arising from product shortages or incidents at the shop, a product cannot be supplied, this will be indicated on the Website or the User will be contacted to inform them if necessary.
• BREAD AR, S.L. reserves the right to change the list of products without prior notice. However, it undertakes not to change the characteristics of products included in orders that Users have already placed.
• There is no right of withdrawal due to the perishable nature of the products supplied.
• The User will have the restaurant staff available at the premises where the order is placed to resolve incidents and provide customer service, as well as the premises' telephone number shown on the Website, which can be used to contact BREAD AR, S.L. to place orders, resolve incidents and obtain customer service. If an incident is not resolved with the assigned premises, you can write to SIETEPECADOSPALMA@GMAIL.COM. Through this channel, BREAD AR, S.L. will record your complaint and inform you of its resolution.

Shop ordering process

1. The User should create a user account to make managing orders easier. Registration is not required to place an order.
2. The User can select the items they want, and these will be added to the basket.
3. Once the purchase is confirmed, a User without a user account will need to fill in the required fields: the personal information needed to place the order, billing details where applicable, and delivery details. Once the User has read and understood these Shop Terms, they can click the corresponding button to accept them and proceed, where applicable, with the payment method.
4. After placing an order, the User will receive an email with the order details, provided they have updated their profile with an email address correctly validated through a verification and activation email.

Price and payment method

Before final confirmation, a summary of the online order will be shown, and the User can correct any of the details entered. Final confirmation of the order constitutes the conclusion of the contract with BREAD AR, S.L. Where this option is enabled and the User chooses it, the User must make the payment for the delivery process to begin.

BREAD AR, S.L. may reject a User's order if the User does not complete the payment correctly. When paying by card, if the card is declined, the User will be informed and asked to pay by another method. If this is not possible, the order will be cancelled and the User notified by email.

The User may pay for their order using the following methods, to the extent that they are available for the shop:

• Credit card: Banking details collected through the payment gateway are encrypted and transmitted securely to the bank's servers. BREAD AR, S.L. reserves the right to take any legal action it considers appropriate against anyone who carries out a fraudulent transaction or enters credit card details without the cardholder's authorisation. When paying by credit card, the order will not be considered effective until the BREAD AR, S.L. Administration Department obtains bank confirmation of the payment.
• Cash, Restaurant Voucher or Credit card: Payment will be made directly to the waiter or at the restaurant till.

Regardless of the payment method chosen, the User will receive an order confirmation email provided they have previously registered and validated their email address. The order details will be recorded by BREAD AR, S.L. in the personal account created by the User on the Website.

The prices shown for each product include applicable taxes, and the final summary before checkout will include any additional items such as delivery charges, if any apply.

Delivery and returns policy

Once payment has been checked and validated, BREAD AR, S.L. will deliver the product according to the details provided. The details of each restaurant are available to the User on the Terms and Conditions page.

The User is responsible for entering the delivery address for the order correctly. If the address is entered incorrectly, BREAD AR, S.L. will try to contact the User to correct the error, but accepts no liability arising from such errors on the part of the User.

The delivery time, which is in all cases approximate, will be shown when the order is placed. BREAD AR, S.L. is not responsible for any delay caused by reasons beyond its control.

The User must check the products received in the presence of the delivery staff to verify their integrity and condition in order to confirm their acceptance. If the User is not satisfied with the product received, they must tell the delivery staff, who will offer the option of refunding the price of the product or processing a new order for the same product, following receipt of the product under the delivery conditions.

In accordance with Law 11/2010, of 17 December, on the prevention of alcohol consumption by minors, it is prohibited to sell alcoholic drinks to people under 18, or to people over 18 on behalf of people under 18. Orders containing alcohol cannot be accepted by people under 18.

Legal age

To purchase products in the “shop” of SIETE PECADOS PALMA (PALMA DE MALLORCA), Users who register must be over eighteen (18) years of age, must follow the instructions that appear on screen and will be required to carry out the following steps, as well as any others included on the various screens of the Shop: complete in full the electronic form shown in the Shop at any given time, following the instructions given in it.
